Notice of Privacy Practices
Effective date: 09/30/2026
THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.
Resolve Therapy, LLC (“Resolve,” “we,” or “the Practice”) provides mental health services in Ohio. We create records of the care you receive to support your treatment and meet legal requirements. This Notice applies to records of your care maintained by Resolve. It explains how we may use and disclose protected health information (PHI), your rights, and our responsibilities. PHI includes information that identifies you and relates to your health, care, or payment for care. We must maintain the privacy and security of PHI and follow this Notice. Ohio law and professional confidentiality rules may provide additional protections; where a more protective rule applies, we will follow it.
Your Rights
To exercise a right, contact the privacy contact listed at the end of this Notice. We may ask you to put certain requests in writing and verify your identity.
Right to Request a Copy of Your Record. You may request to inspect or receive an electronic or paper copy of health information in our designated record set. We will respond within the time required by law. . We may charge a reasonable, cost-based fee as permitted by law. In limited circumstances, we may deny access if allowed by law and, when applicable, explain how to seek review. Separately maintained psychotherapy notes have different access rules.
Right to Request an Amendment. You may ask us to amend information you believe is incorrect or incomplete. We may require a written request and a reason. If we deny the request, we will explain why in writing, generally within 60 days, and explain your right to submit a statement of disagreement.
Right to Request Confidential Communications. You may ask us to contact you in a particular way or at a particular address. We will accommodate reasonable requests.
Right to Request Limits on Uses and Disclosures. You may ask us to limit information used or shared for treatment, payment, or health care operations, or with a person involved in your care. We are generally not required to agree.
If you pay for a service in full out-of-pocket and request that we not disclose information about that service to your health plan for payment or health care operations, we must honor that request unless disclosure is required by law. Tell us before a claim is submitted so we can address the request.
Right to Obtain an Accounting of Disclosures. You may request an accounting of certain disclosures during the preceding six years.
It does not include many disclosures for treatment, payment, or operations or other exceptions allowed by law.
We will respond within 60 days, subject to an extension allowed by law. One accounting in any 12-month period is free; an additional accounting may involve a reasonable, cost-based fee.
Right to a Copy of this Notice. You may request a paper or electronic copy. You may request a paper copy at any time, even if you agreed to receive it electronically.
Right to Choose a Representative. A person legally authorized to act for you may exercise your rights, subject to applicable law. We will verify that authority.
Right to File a Complaint. You may submit a complaint to us using the contact information at the end of this notice.
We will not retaliate against you for making a complaint.
Right to Revoke an authorization. You may withdraw a written authorization to use or share your health information at any time by notifying Resolve in writing. This will not undo uses or disclosures we already made in reliance on your authorization.
Right to Receive Information about a breach of your Protected Health Information
How Information is Used and/or Shared
Treatment. We may use information to provide care and, when permitted by applicable law, share relevant information with other professionals involved in your treatment. For example, we may consult with another healthcare provider.
Payment. We may use or share information to bill you, obtain payment, verify benefits, or submit an insurance claim. A health plan may receive information such as a diagnosis and service dates when a claim is submitted.
Health Care Operations. We may use or share information to manage the Practice, assess quality, conduct permitted reviews, and contact you about your care. Companies that provide services for us, such as our electronic health record, telehealth, payment, or communications providers, may receive information under appropriate privacy agreements and safeguards.
Appointment reminders and care options. We may contact you about appointments, treatment alternatives, and health-related services that may be relevant to your care, subject to your reasonable request for a particular method of communication.
Limits on the amount shared. When the HIPAA “minimum necessary” rule applies, we limit information used, requested, or disclosed to what is reasonably needed for the purpose. That rule does not apply to disclosures to or requests by a health care provider for treatment, among other exceptions. Other confidentiality requirements and our professional judgment still apply. Ordinary clinical progress notes and separately maintained psychotherapy notes are treated differently, as described below.
People involved in your care. With your agreement, or when you have an opportunity to object and do not object, we may share information relevant to a family member, friend, or other person involved in your care or payment for care. If you cannot tell us your preference, we may share information when we determine that doing so is in your best interest, as permitted by law. Ohio mental health confidentiality requirements may call for your written consent in circumstances where HIPAA alone would allow disclosure; we will apply the stricter requirement when it governs.
Other disclosures permitted or required by law. Depending on the circumstances and applicable protections, we may use or share information for:
Required reports of suspected child, elder or animal abuse or neglect, certain public health purposes, or a serious threat to health or safety, including duties concerning threats to identifiable persons under Ohio law;
Health oversight, workers’ compensation, or legally authorized government functions;
Legally authorized requests from coroners or medical examiners;
Judicial proceedings or law enforcement requests when a valid legal basis permits or requires disclosure; and
Disclosure to the U.S. Department of Health and Human Services to demonstrate compliance with federal privacy law.
Subpoenas and legal requests. A subpoena alone does not automatically mean that all therapy records will be released and we must respond to administrative and court ordered subpoenas, but not others issued by just an attorney. We review each request for applicable legal requirements, privileges, and protections before disclosing information.
Research. We may use or share information for research only when a legal authorization or other applicable privacy-rule pathway permits it. Resolve does not conduct research at this time.
When Your Written Authorization Is Required
We will ask for your written authorization before using or sharing your health information for a purpose that requires it under law.
Psychotherapy notes. If your clinician keeps notes about a session conversation separately from your clinical record, most uses or disclosures of those notes require your written authorization. Limited exceptions include the clinician’s use of the notes to treat you and certain uses permitted or required by law. Sharing them with another treating provider ordinarily requires your authorization. Progress notes in your clinical record are different from these separately maintained notes.
Marketing, Sale, and Fundraising
Marketing: We will not use or share your health information for marketing without your written authorization when the law requires it. We may contact you about your care and treatment options.
Sale: Resolve Therapy does not sell your health information.
Fundraising: Resolve Therapy does not currently use your health information for fundraising. If this changes, we will provide any notice and opportunity to opt-out required by law.
Substance Use Disorder Records
If we receive or maintain any information about you from a substance use disorder treatment program that is covered by 42 CFR Part 2 (a “Part 2 Program”) through a general consent you provide to the Part 2 Program to use and disclose the Part 2 Program record for purposes of treatment, payment or health care operations, we may use and disclose your Part 2 Program record for treatment, payment and health care operations purposes as described in this Notice. If we receive or maintain your Part 2 Program record through specific consent you provide to us or another third party, we will use and disclose your Part 2 Program record only as expressly permitted by you in your consent as provided to us.
In no event will we use or disclose your Part 2 Program record, or testimony that describes the information contained in your Part 2 Program record, in any civil, criminal, administrative, or legislative proceedings by any Federal, State, or local authority, against you, unless authorized by your consent or the order of a court after it provides you notice of the court order.
Other uses and disclosures will require your signed authorization, unless the use or disclosure is allowed or required by law. Once information is disclosed it may be redisclosed by the recipient and will no longer be protected by law.
Our responsibilities and changes to this Notice
We must:
Maintain the privacy and security of your PHI;
Provide this Notice and follow its current terms; and
Notify you following a breach of unsecured PHI when the law requires notice.
We may change this Notice; changes may apply to PHI we already hold. A revised Notice will be available on our website and upon request, and we will provide it as required by law.
